These Terms of Service govern your use of the Mayflower Munchies website and orders placed through it.

By using this website or placing an order, you agree to these terms. Nothing in these terms limits or excludes your statutory consumer rights.

1. About Mayflower Munchies

Mayflower Munchies is a family-run Pick ’n’ Mix business established in Plymouth in 2013.

We sell Pick ’n’ Mix sweets, Create Your Own bags, ready-made sweet bags, chocolate, snacks and related products through this website.

2. Product information

We aim to describe our products, weights, flavours, ingredients, allergens, packaging and images accurately.

Product packaging, appearance, colours, recipes and ingredients may change when manufacturers or suppliers update their products. Images may also appear slightly different because of photography, packaging changes or screen settings.

If a product you receive is materially different from its description, your statutory rights are not affected.

All products are subject to availability.

3. Ingredients, allergens and dietary information

Please read the product-specific ingredient and allergen information carefully before ordering.

Manufacturers may change recipes, ingredients and manufacturing methods. Customers should therefore check the packaging supplied with the product before consumption.

Sweets are stored, handled and packed in a mixed sweet-shop environment where allergens may be present. Although we take care when preparing orders, we cannot guarantee that cross-contact will never occur.

We do not describe a product as allergen-free unless that statement is expressly supported by reliable manufacturer or supplier information.

Dietary descriptions such as vegan, vegetarian or gluten-free are shown only where they have been verified using the information available to us. These descriptions do not amount to a guarantee against cross-contact.

If you have an allergy, intolerance, coeliac disease or another dietary concern, contact us before ordering if you are unsure whether a product is suitable.

4. Prices and payment

All prices are shown in pounds sterling.

The product price, delivery charge and final order total are displayed at checkout before payment.

We may update prices, offers, descriptions and availability before an order is placed. Changes will not affect an order that has already been accepted, except where required by law or where there is an obvious pricing error.

If an item has been listed at a clearly incorrect price, we may contact you before dispatch to offer the correct price or cancel the affected item or order. Any payment taken for a cancelled item will be refunded.

5. Placing and accepting an order

Placing an order through the website is an offer to purchase the selected products.

An automated order acknowledgement confirms that we received your order. We normally accept an order when we begin processing it for dispatch.

We may be unable to accept an order because:

  • A product is unavailable.

  • Payment cannot be authorised.

  • We cannot deliver to the supplied address.

  • An obvious product or pricing error has occurred.

  • We reasonably suspect fraud or unlawful activity.

  • A legal or safety restriction prevents fulfilment.

If we cannot fulfil a paid order, we will contact you and refund the affected amount.

We will not send a materially different substitute without contacting you, unless the product page clearly stated a specific substitution policy that you accepted when ordering.

6. Create Your Own orders

Create Your Own bags are assembled using the bag size and sweet selections chosen by the customer.

The price shown before adding the completed bag to the basket includes its base price and any product-specific additional charges displayed during selection.

Customers must complete the required number of selections before a Create Your Own bag can be added:

  • 500g: exactly 10 × 50g picks.

  • 1kg: exactly 20 × 50g picks.

Repeated sweet selections are allowed.

Customers should review the displayed packing list and total price before adding the bag to their basket.

7. Delivery

We currently deliver to addresses within the United Kingdom.

Available UK delivery services are:

  • Standard delivery — £3.99: estimated 3–5 business days.

  • Express delivery — £4.59: estimated 2–3 business days.

  • Priority delivery — £5.49: estimated 1–2 business days.

Standard delivery is free on orders of £30 or more.

Priority delivery is not guaranteed to arrive on the next working day. Available services and final delivery charges are confirmed at checkout.

Local Plymouth delivery is temporarily paused and should not appear as an available checkout option.

Orders are packed and dispatched on working days. Delivery estimates are not guarantees and may be affected by courier disruption, weather, seasonal demand or circumstances outside our reasonable control.

Unless a different delivery period has been agreed, goods will be delivered without undue delay and normally within 30 days of the contract being formed.

8. Responsibility for goods during delivery

We remain responsible for an order until it comes into the physical possession of the customer or another person identified by the customer to receive it.

Different rules may apply if the customer independently arranges a carrier that we did not offer as a delivery option.

9. Warm weather

Chocolate and other heat-sensitive products may soften or melt during warm weather.

We pack orders with care, but customers should consider current temperatures before ordering heat-sensitive products. Ordering these products during hot weather carries an increased risk of heat-related changes during transit.

Nothing in this section limits your statutory rights where goods are faulty, damaged or not as described.

10. Cancelling an order

If you want to cancel an order before dispatch, email contact@mayflower-munchies.co.uk as soon as possible.

We will try to stop the order if preparation or dispatch has not been completed, but we cannot guarantee that this will be possible.

For many online purchases, customers normally have 14 days after receiving the goods to tell the seller that they wish to cancel. They then normally have a further 14 days to return the goods.

Legal exceptions may apply to certain goods, including:

  • Goods made to the customer’s specifications or clearly personalised.

  • Goods liable to deteriorate or expire rapidly.

  • Sealed goods that are unsuitable for return for health or hygiene reasons after being unsealed.

Whether an exception applies depends on the particular product and circumstances. Merely packing a standard product to order does not automatically remove statutory cancellation rights.

A Create Your Own bag assembled using an individual customer’s selected mixture may be treated differently from an unchanged standard product where the legal requirements for an exception are met.

Nothing in these terms removes rights relating to faulty, damaged, unsafe or incorrectly described goods.

11. Damaged, faulty, missing or incorrect orders

If an order arrives damaged, faulty, incorrect or incomplete, contact us as soon as reasonably possible.

Reporting a problem within 24 hours helps us investigate it quickly, but this is not intended to limit your statutory rights.

Please provide:

  • Your order number.

  • A description of the problem.

  • Photographs of the affected products where relevant.

  • Photographs of the parcel, packaging and delivery label where relevant.

Please keep the affected products and packaging until we have responded.

Goods must be of satisfactory quality, fit for their intended purpose and as described. Your legal rights continue to apply where these requirements are not met.

12. Refunds

Approved refunds will normally be returned to the original payment method.

Where the law gives you a right to a refund, it will be processed within the legally required timeframe.

Processing by your bank or payment provider may mean that a completed refund takes additional time to appear in your account.

13. Customer accounts

If you create an account, you are responsible for keeping your login information secure.

Please contact us if you believe somebody has accessed your account without permission.

You are not responsible for unauthorised activity caused through no fault of your own.

14. Acceptable website use

You must not:

  • Use the website for an unlawful or fraudulent purpose.

  • Attempt to gain unauthorised access to the website or another customer’s account.

  • Introduce malicious software or interfere with the website’s operation.

  • Copy or exploit website content in a way that infringes our rights or the rights of another party.

15. Privacy

Our Privacy Policy explains how personal information is collected, used and protected.

Shopify and other service providers may process information necessary to operate the store, accept payments and fulfil orders.

16. Liability

We do not exclude or limit liability where doing so would be unlawful. This includes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, and rights that cannot legally be excluded.

Subject to those protections, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from purchases made wholly for personal use.

We are not responsible for delay or failure caused by events genuinely outside our reasonable control, although this does not remove any remedy the law gives you.

17. Changes to these terms

We may update these terms when our services, business practices or legal obligations change.

The version applying when an order is accepted will normally govern that order unless the law requires otherwise.

18. Governing law

These terms are governed by the applicable laws of the United Kingdom.

Consumers may bring proceedings in the courts available to them under applicable law, including the courts covering the part of the United Kingdom in which they live.
